US DOT Penalizes European Airlines for Endangering Delta Passengers Over Iraqi Airspace
Geopolitical Risks and Violations
Passenger safety in aviation is a major dispute. The federal agency confirmed the breach on Friday, October 23. The airlines flew Delta Air Lines flight codes through restricted Iraqi territory. This region carries high geopolitical tension. This is not the first instance of such penalties. In 2024, DOT also fined Ethiopian Airlines and Etihad Airways. They used United Airlines and JetBlue codes in the same restricted airspace.

Delta's relationship with its European partners is a complex joint venture. Codeshare agreements allow mutual use of flight codes and coordinated sales. Air France and KLM must follow strict FAA rules. This includes the ban on flying over Iraq. This is considered a „foreign state-administered airspace.”Transport Secretary Sean P. Duffy stated safety compliance is not optional. He vowed to penalize non-compliant airlines. Passenger safety remains the absolute priority.
Penalty Details and Legal Basis
CNBC reported the FAA bans flights over Iraq below 32,000 feet. This preventive measure has been active for over six years. DOT ordered a total fine of $425,000 for codeshare rule violations. Air France faces $105,000. KLM is obligated to pay $320,000. This action is based on 49 U. S. C. § 41301. The DOT's Air Passenger Protection Unit conducted the investigation. Both airlines must cease and desist from future deviations.
Regulatory Authority and Passenger Impact
DOT orders show the department's enforcement power. This applies even while rules on unforeseen events are being reviewed. A change on October 19 might affect passenger compensation. Airlines must pay the main fines within 60 days. Further payments are due only if new violations occur within one year. KLM must pay $200,000 in 60 days. Air France owes $65,000 in that same period. Authorization clearly states codeshare operations require no flight over a restricted FAA zone.
Scope of the Iraqi Airspace Ban
The FAA ban over Iraq, active since October 2020, targets all operators. This includes American and commercial US operators. Flights through the Baghdad ORBB FIR below FL 320 are prohibited. This restriction automatically covers Air France and KLM flights using the DL code. The DOT extended this restriction until October 26, 2027.
Implications for Travelers
Codeshare agreements let passengers book flights under one carrier's number. A Delta flight number does not guarantee Delta operates the plane. Delta sells tickets for flights run by partners like Air France and KLM. Passengers booked via Delta flew on the European carriers over the banned Iraqi airspace. Since US safety rules apply to foreign carriers using a US code, this generated the fines.
